Task

This assessment will set the scene for your work in the assessments to come. It will also help you to demonstrate achievement of the subject learning outcomes on communicating specialised industrial relations information to a variety of audiences, and the outcome centred on peer engagement.
Top Juice is a real company operating in Sydney and other Eastern Australia sites (http://www.topjuice.com.au/). The company uses a franchise model, as well as operating company owned stores. Visa holders make up a significant proportion of the workforce. You are asked to prepare a presentation to the management team at Top Juice on the employment of visa holders in its Australian outlets. [Please do not contact the company when preparing this assessment.
 In the context of your target audience, your task in Assessment 1 has two parts.
Part A (2 x powerpoint slides) (6 marks)
Prepare an infographic that depicts the following:
– The rights of s457 visa holders in the Australian IR system
– The rights of student visa holders in the Australian IR system. (References required at the foot of slide 2.)
Part B (Powerpoint presentation of up to 8 slides, well presented (see below for further explanation) (14 marks)
Discuss the current debate relating to the engagement of visa holders in Australia, in context of the narrative on ‘jobs for Australians’. Questions to address here include, but are not limited to, the following: 
– How does the nature of the employment relationship, as explained in Topic 1, apply to visa holders; what are the limitations, if any, of the duality between market and employment relationship when applied to visa holders (References not essential.); (Formal or informal rules Apply any of the theory which apply from these 1. Unilateral, 2. Bialateral 3. Multilateral Theory).
– Who are the stakeholders in rule-making in the case of visa holders; what is the nature of the rules that apply to visa holders as employees (References not essential.);
– How does employment relations theory and values frameworks help us to make sense of the current debate surrounding the employment of visa holders in Australia. (References needed.) (Radicalism, Plurism Theory).HRM same as UNITARISM. For example 1. 500 visa linked to Plurism theory 457 compared to unitarism.
Completion of the assessment task involves two steps:
(i) Discussion of work-in-progress on your presentation to your peers, as arranged by your lecturer;
(ii) Upload of a powerpoint presentation to Turnitin by the due date shown above.
You are asked to prepare the assessment individually, and present your work-in-progress prior to final submission by the due date shown above. A final powerpoint presentation must upload to Turnitin by the due date.

Discussion of visa holders in Australia in the context of Jobs for Australians

 There has been a wide debate and talk about the engagement of s457 and student visa holders within the employment sector in Australia.  This has been immensely sparked by the increasing number of such visa holders in the work industry in the country and particularly in the Top juice company.

Nature of employment relationships and its application to visa holders

All workers in Australia inclusive of those from foreign countries are entitled to fundamental rights and protections in their working places. This mainly includes the award of fair opportunities to such visa holders in the country who are increasingly forming a majority of the Australian workforce as evidenced by the high number of visa holder employees in Top Juice Company.  Permanent residents, seasonal workers and international students who are holders of those visas are entitled to all the rights of a worker in Australia. 

 Formal rules apply in protecting the welfare of visa holders in the country. They adequately protect employees since the workplace laws cut across all the workers formally or informally employed in Australia.  Most of the nature of the employment for the visa holders are professional.  However, there are is quite some workers who are employed by their informal skills in a majority of companies in the nation.

Limitations of the duality between market and employment relationship when applied to visa holders

One of the key shortcomings of such a duality application to visa holders is that at times the market may not be responsive to the professional or informal skills that the visa holders possess at that particular time.  As a result, you find that quite some such a group is either not fully absorbed into the market or are absorbed but on a temporary basis.

Parties involved in making rules applicable to visa holders

The chief stakeholders include the government through the department of immigration and the employers who hire these visa holders.  The natures of the rules that are enforced to all visa holders in the country include the Australian workplace laws, Australian immigration laws, and the commonwealth workplace laws.  All of these laws or rules are chiefly meant to protect the interest and welfare of the visa holders.

The relevance of the employment relations theory and values frameworks in the debate

The employment relations theory, for instance, enables us to establish the effect of work relations within a workplace context to the employment of a visa holder in the country may it be on a permanent or temporary basis.  The theory is useful in pointing out how the varied natures of work relationships are either positively or adversely impacting the hiring of visa holders in Australia.  This may be contributing to explaining the high number of visa holder employees at Top Juice Company.  The values frameworks are useful in this case in that they link the value systems held by Australian visa holders to the employment demands in the market
