As discussed in the textbook, there are many purposes fulfilled by the law, including:

  • Providing order such that one can depend on a promise or an expectation of obligations
  • Serving as an alternative to fighting
  • Facilitating a sense that change is possible, but only after a rational consideration of options
  • Encouraging social justice
  • Guaranteeing personal freedoms
  • Serving as a moral guide by indicating minimal expectations of citizens and organizations
  • Prohibiting individual justice

Based on your personal ideology, rank the foregoing purposes of law from most to least important, and discuss your rankings with fellow students. What factors influenced you in determining your rankings? In your reasoned opinion, is it possible to achieve all of the purposes of law simultaneously, or are certain purposes mutually exclusive (for example, providing order precludes guaranteeing personal freedoms)?”

Answer:

  • Serving as a moral guide by indicating minimal expectations of citizens and organizations
  • Facilitating a sense that change is possible, but only after a rational consideration of options
  • Providing order such that one can depend on a promise or an expectation of obligations
  • Serving as an alternative to fighting
  • Guaranteeing personal freedoms
  • Encouraging social justice
  • Prohibiting individual justice

I ranked these the way I did because I believe why we follow rules and do the things we do rely on morals, ethics, logic. Humans have a conscience which is why i ranked moral guide and a sense that change is possible so high. The rest of the laws are a close tie with individual justice at the bottom because it happens anyways.

In the appendix to Chapter 2, you read about various theories of business ethics.  For each of the following characters, please discuss which theory the character most represents and why (giving one or more examples from the short):

1. Horton the Elephant

2. Maisie the Bird

3. Horton’s friends

4. The elephant hunters

Answer:

Horton is the ethics of care. Horton deeply cares about other people and wants to help them, in this case, Maisie. Horton wants to help Maisie just to be a nice person and build better relationships.

Maisie is ethical relativism. Maisie is ethical relativism because each situation she is in, she doesn’t hold the same values but rather evaluates and finds her own right and wrong for each case. case one was to make Horton watch the egg because it benefited her so she can take a vacation. case 2 was when she ran into Horton again and saw the egg begin to hatch, now she never intended to go back for the egg is the general view that the short creates yet in that situation it was her egg despite any of the effort put into it to hatch it.
